Please review these Terms and Conditions of Use carefully ("Terms") before using the services offered by Siftmind (also "we", "us", "our").
These Terms constitute a legally binding agreement between us and you, and regulate your use of the services accessible via the Siftmind mobile application (the "App"), together with all related services, information, text, graphics, audio, software and our emails (the "Content"). To make these Terms easier to read, the App, the Content and our services are collectively called the "Services".
The Services are provided free of charge. If we introduce paid features in the future, we will publish separate purchase terms and obtain your agreement before charging you anything.
IMPORTANT NOTICE REGARDING ARBITRATION FOR U.S. USERS: WHEN YOU AGREE TO THESE TERMS YOU ARE AGREEING (WITH LIMITED EXCEPTION) TO RESOLVE ANY DISPUTE BETWEEN YOU AND SIFTMIND THROUGH BINDING, INDIVIDUAL ARBITRATION RATHER THAN IN COURT. PLEASE REVIEW CAREFULLY SECTION 12 "MANDATORY BINDING ARBITRATION AND CLASS ACTION WAIVER" BELOW.
FURTHERMORE, THESE TERMS CONTAIN IMPORTANT DISCLAIMERS (SECTION 2), DISCLAIMERS OF WARRANTIES (SECTION 9), LIMITATION OF LIABILITY (SECTION 10) AND A CLASS ACTION WAIVER (SECTION 12).
1.1 These Terms establish a legally binding contractual relationship between you and Siftmind. For this reason, PLEASE READ THE TERMS CAREFULLY BEFORE USING THE SERVICES.
1.2 Please also review our Privacy Policy. The terms of the Privacy Policy and any other supplemental terms, policies or documents posted on the Services from time to time are expressly incorporated herein by reference.
1.3 We may change these Terms by posting an updated version on the page where these Terms are published. We may provide you with notice of material changes, for example by email or by posting a notification on the Services, but are not obliged to do so in every case. Other changes will be notified to you only by updating the "Last Updated" date of these Terms, and you waive any right to receive specific notice of each such change. If you do not agree to the changes, you should stop using the Services. Use of the Services after changes to these Terms are made means that you accept those changes.
1.4 IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, OR IF YOU ARE NOT ELIGIBLE OR AUTHORISED TO BE BOUND BY THESE TERMS, THEN DO NOT DOWNLOAD THE APP OR OTHERWISE ACCESS OR USE THE SERVICES.
THE APP CONTAINS SUMMARIES BASED ON KEY INSIGHTS FROM NON-FICTION BOOKS, IN TEXT AND AUDIO FORM. THE INFORMATION PROVIDED WITHIN SUMMARIES IS FOR EDUCATIONAL PURPOSES ONLY.
WE DO NOT OFFER OR PROVIDE ANY KIND OF MEDICAL ADVICE OR OTHER HEALTHCARE SERVICE, INCLUDING WITHOUT LIMITATION ANY TESTING, DIAGNOSIS OR EVALUATION RELATED TO MENTAL HEALTH. NOR DO WE PROVIDE LEGAL OR FINANCIAL ADVICE. IF YOU HAVE ANY PROBLEM WITH YOUR HEALTH, YOU SHOULD VISIT, CALL OR CONSULT YOUR PHYSICIAN OR OTHER HEALTHCARE PROFESSIONAL.

A BOOK SUMMARY DOES NOT CONSTITUTE AN ENDORSEMENT BY US OF ANY OF THE AUTHORS MENTIONED IN THE APP. NOTHING IN THE APP SHALL BE TAKEN TO MEAN THAT ANY OF THE MENTIONED AUTHORS AUTHORISES, SUPPORTS, ENDORSES OR SPONSORS ANY PRODUCT OR SERVICE OF OURS AS A RESULT OF BEING MENTIONED IN THE APP.
3.1 In order to use the Services, you must register a profile in the App ("Profile") and provide certain information about yourself as prompted by the registration form. You may register using Sign in with Apple, Google Sign-In, or an email address and password.
3.2 If you register a Profile, you represent and warrant to us that: (i) all required registration information you submit is truthful and accurate; (ii) you will maintain the accuracy of such information; and (iii) your use of the Services does not violate any applicable law or regulation or these Terms. Otherwise, the Services may not operate correctly, and we may not be able to contact you with important notices.
3.3 The Services are not intended to be used by individuals under the age of 16. You represent and warrant to us that you meet that qualification. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Services. If you are a minor, you must have your parent or guardian read and agree to these Terms before you use the Services.
